Gadget Medics Broken Club – Free Plan Terms of Service
Effective Date: May 13, 2025
Welcome to Gadget Medics Broken Club (the “Club”). By enrolling in, accessing, or using the Broken Club Free Plan (the “Plan”), you (“Member,” “you,” or “your”) agree to be bound by these Terms of Service (the “Terms”) and any policies or documents referenced herein. If you do not agree to these Terms, do not enroll in or use the Plan.
1. Acceptance & Modification of Terms
1.1. Binding Agreement. These Terms constitute a legally binding agreement between you and Gadget Medics LLC (“Gadget Medics,” “we,” “us,” or “our”).
1.2. Updates. We may modify these Terms at any time. Changes become effective when posted to our website or otherwise communicated to you. Continued participation after changes are posted constitutes acceptance of the revised Terms.
2. Plan Overview & Member Benefits
2.1. No Membership Fee. The Free Plan carries no recurring membership fee once activated (see § 3).
2.2. Member Benefits while your membership is active:
The complete, current list of Broken Club Free Plan benefits is published on our website at gadgetmedics.com/broken‑club. Benefits may be added, modified, or discontinued at any time, and the online list always prevails over any printed or prior descriptions. Please review the website to confirm available perks—such as discounts, warranties, complimentary services, and promotional items—before booking service.
3. Activation Requirement
3.1. Qualifying Repair Threshold. To activate your membership and unlock Plan benefits, you must first complete and fully pay for any single repair service totaling US $100 or more (before tax and after discounts) performed by Gadget Medics (“Qualifying Repair”).
3.2. Activation Date. Your Plan becomes active 24 hours after the date on the paid invoice for the Qualifying Repair (“Activation Date”).
3.3. Inactive Accounts. If no Qualifying Repair is completed within six (6) months of enrollment, your pending enrollment will be cancelled and any provisional benefits lapse.
4. Eligibility & Enrollment
4.1. Age & Authority. You must be at least 16 years old and capable of entering into a contract. If you enroll on behalf of an entity, you represent that you have authority to bind that entity.
4.2. Enrollment. Enrollment is complete when you submit the Broken Club sign‑up form in‑store or online and receive confirmation of acceptance.
4.3. Accurate Information. You agree to provide and maintain accurate, current, and complete information, including contact details and device information.
5. Member Responsibilities
5.1. Proper Use. You agree to use Plan benefits only for personal, lawful purposes and not to abuse, transfer, or resell them.
5.2. Device Ownership. You represent that you are the legal owner or authorized user of any device presented for service.
5.3. Data Backup. You are solely responsible for backing up data. Gadget Medics is not liable for loss, recovery, or compromise of data or media during service.
6. Repairs, Warranty & Service Terms
6.1. Service Scope. Repairs are limited to devices and defects Gadget Medics is equipped to service. Diagnostic assessments may determine serviceability.
6.2. Parts. Repairs may use new OEM, refurbished OEM, or compatible third‑party parts at your direction, subject to availability.
6.3. Broken Club Exclusive Warranty. While your membership remains active and your digital Broken Club card is stored in your device’s wallet, you receive:
- Lifetime warranty on hardware repairs performed by Gadget Medics.
- These exclusive warranties replace the standard warranty duration written on https://gadgetmedics.com/warranty-policy/ .
6.5. Warranty Exclusions. Warranty coverage is void for subsequent accidental damage, liquid exposure, unauthorized repairs, or software modifications performed after Gadget Medics’ service. Eligibility determinations are at Gadget Medics’ sole discretion.
7. Pricing & Payments
7.1. Repair Costs. Except for expressly free benefits, all parts, labor, taxes, and optional services are billed at prevailing rates minus any applicable Club discount.
7.2. Estimates. Written estimates expire after seven (7) days. Prices may change due to parts availability or additional issues discovered during service.
7.3. Payment Due. Payment in full is due upon completion of service. Accepted payment methods are listed at the time of service.
8. Term, Suspension & Cancellation
8.1. Term. Membership begins on the Activation Date and continues until canceled by you or terminated by us.
8.2. Cancellation by You. You may cancel your membership at any time by removing your Broken Club card from your digital wallet.
8.3. Suspension/Termination by Us. We may suspend or terminate membership immediately for violation of these Terms, suspected fraud, abuse, or illegal activity.
8.4. Effect of Cancellation. Deleting the card constitutes your formal request to cancel, and all accumulated points and percentage‑based discounts will be cleared immediately. After 15 days, these benefits cannot be reinstated.
9. Intellectual Property
All Gadget Medics names, logos, and content are our property or licensed to us. Nothing grants you rights to use our intellectual property without prior written consent.
10. Privacy & Data Security
We handle personal information in accordance with our Privacy Policy. By enrolling, you consent to collection, use, and sharing of information as described therein.
11. Disclaimer of Warranties
EXCEPT AS EXPRESSLY PROVIDED, THE PLAN AND ALL BENEFITS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GADGET MEDICS DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GADGET MEDICS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.
Indemnification Terms for Gadget Medics Broken Club Members
You agree to indemnify and hold harmless Gadget Medics, its affiliates, and employees from any claim arising out of your breach of these Terms or misuse of the Plan.
14. Dispute Resolution & Governing Law
14.1. Governing Law. These Terms are governed by the laws of the State of Florida, USA, without regard to conflict‑of‑law principles.
14.2. Arbitration. Any dispute arising from these Terms shall be resolved by binding arbitration in Palm Beach County, Florida, under the rules of the American Arbitration Association. You waive the right to a jury trial and to participate in class actions.
15. Severability & Waiver
If any provision is found unenforceable, the remaining Terms remain in effect. Failure to enforce any provision is not a waiver of that provision.
16. Entire Agreement
These Terms constitute the entire agreement regarding the Free Plan and supersede prior agreements or representations.
